(The Clifford and Lillian Fielding Foundation have donated $245,000 to the City of Greater Sudbury to enable the City to purchase the Long Lake Public School from the Rainbow District School Board. This report recommends that the park created by the purchase of the school and the existing Long Lake Playground be named Kivi Park in recognition of this donation and in accordance with conditions defined within the Building, Property and Park Naming Policy.)

MOTIONS

M-1. Waste By-law Amendment Request
As presented by Councillor Sizer,

WHEREAS in 2015 the City of Greater Sudbury has experienced a higher than usual number of bear visits, sightings and encounters;

AND WHEREAS the Bear Wise Program suggests that in order to prevent bear encounters, people should only place garbage containers on the morning of garbage collection day, not the night before;

AND WHEREAS By-law 2006-280 being a By-law of the City of Greater Sudbury Dealing with the Collection, Removal, and Disposal of Waste Within the City of Greater Sudbury stipulates that owners of properties which receive daytime waste collection services as determined by the General Manager, shall not place any waste contained at the collection location earlier than 8:00 p.m. on the evening before, nor later than 7:00 a.m. on the day waste collection services for garbage are scheduled to be provided to that property;

AND WHEREAS By-law 2006-280 should be amended to reflect the recommendations from the Bear Wise program in order to assist in the prevention of bear visits and encounters;

THEREFORE BE IT RESOLVED that By-law 2006-280 be amended to add that during the period from April 1st to November 30th, the owners of properties which receive daytime waste collection services as determined by the General Manager, shall not place any garbage container at the collection location earlier than 5:00 a.m. and not later than 7:00 a.m. on the day waste collection services for garbage are scheduled to be provided to that property, and that the said amendment take effect on April 1st, 2016;

AND BE IT FURTHER RESOLVED that once the amended by-law is passed by Council, that the City of Greater Sudbury proceed with an education campaign well in advance of April 1st, 2016 so that all residents are aware of the changes when they take effect.

M-2. Uber and other ride sharing systems - Request for review
As presented by Councillor McIntosh,

WHEREAS Uber, the smartphone application which connects riders with drivers using their phone’s GPS capabilities, operates in countries and cities all over the world and is constantly expanding its market;

AND WHEREAS Uber and other similar technology-based companies and ride sharing systems will expand their services into Greater Sudbury;

AND WHEREAS Uber is advertising for drivers in the Greater Sudbury area;

AND WHEREAS By-law 2014-115 of the City of Greater Sudbury presently licenses, regulates and governs taxi, limousine and shuttle transportation, but does not apply to the Uber ride service, and other similar technology-based companies, ride sharing systems, or their drivers;

AND WHEREAS the City of Greater Sudbury wishes to establish/create a taxi and ride share environment that is equitable, balances regulation and flexibility, and protects the existing industry while being open to innovation and service enhancement, especially in areas which are not well serviced;

THEREFORE BE IT RESOLVED that the City of Greater Sudbury direct staff from the Administrative Services Department, with input from Economic Development and other departments as appropriate, to undertake a review of the implications of Uber and similar technology-based companies and ride share systems, including the interests of the public in the technology and impacts on the current taxicab and limousine industries, and to report these findings to City of Greater Sudbury Council in the first quarter of 2016 for discussion and deliberation with a long term goal of updating the Taxi By-law.
